By accessing or placing an order through the Power Cookie website, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use this website or place an order.

Power Cookie is a sole proprietorship operating in the State of California. These terms constitute a binding agreement between you and the owner of Power Cookie.

2. Products & Orders

All cookies sold through Power Cookie are baked to order. Orders are confirmed upon receipt of payment. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, errors in product or pricing information, or supply limitations.

By placing an order, you represent that:

• The information you provide (name, address, contact details) is accurate and current.
• You are authorized to use the payment method submitted.
• You have reviewed the allergen information applicable to your order.

3. Perishable Goods & Food Safety

Power Cookie is not responsible for spoilage resulting from improper storage, delayed pickup beyond the agreed window, or failure to follow provided care instructions. We encourage you to inspect your order upon receipt and contact us immediately if there is a concern.

4. Allergen Disclosure

Power Cookie products are prepared in a kitchen that handles common allergens including but not limited to:

• Wheat / Gluten
• Milk / Dairy
• Eggs
• Tree Nuts & Peanuts
• Soy

While we take reasonable precautions, we cannot guarantee that any product is entirely free from cross-contact with allergens. Customers with known food allergies or sensitivities assume all risk associated with their purchase. Power Cookie expressly disclaims liability for any allergic reactions or adverse health responses.

5. Pricing & Payment

All prices are listed in US Dollars and are subject to change without notice. Applicable sales tax will be calculated and displayed at checkout in accordance with California state law.

Payments are processed securely through Stripe and other third-party payment providers. Power Cookie does not store your full payment card information. By submitting payment, you agree to the applicable payment processor's terms and privacy policy.

6. Refund & Return Policy

Exceptions are made solely at our discretion in cases where an order arrives damaged, incorrect, or otherwise materially defective. If you believe your order qualifies, you must notify us within 24 hours of receipt with photographic documentation. We may, at our option, offer a replacement order or store credit — not a cash refund.

Orders cancelled before the baking process has begun may be eligible for a store credit. Once baking has commenced, cancellations are not accepted.

7. Shipping & Delivery

Power Cookie ships within the United States. Shipping costs and estimated delivery windows are displayed at checkout. Delivery times are estimates only and not guaranteed.

We are not responsible for delays caused by shipping carriers, weather events, incorrect addresses provided by the customer, or other circumstances outside our control. Risk of loss and title for shipped products passes to you upon our delivery to the carrier.

If a package is returned to us due to an incorrect or undeliverable address, you may be charged for re-shipment. Power Cookie is not liable for perishable items that spoil in transit due to carrier delays.

8. Local Pickup & Local Delivery

Local pickup and local delivery options may be available depending on your location. Details, pickup windows, and delivery zones are communicated at checkout or upon order confirmation.

• Pickup: Orders not collected within the designated pickup window may be forfeited without refund, as our products are perishable and cannot be held indefinitely.
• Local Delivery: A valid delivery address within our service area is required. If no one is available to receive the order, items left at the door are done so at the customer's risk. Power Cookie is not liable for theft, spoilage, or damage after delivery has been completed.

9. Subscription Orders

Power Cookie may offer recurring subscription plans for regular cookie deliveries. By enrolling in a subscription, you authorize Power Cookie to charge your payment method on a recurring basis at the selected frequency.

You may cancel or modify your subscription at any time before the next scheduled billing date by contacting us directly. Cancellations made after the billing date for an upcoming order will not be refunded for that billing cycle. Power Cookie reserves the right to modify subscription pricing with advance notice to subscribers.

10. Limitation of Liability

Power Cookie is a sole proprietorship and operates to the best of its ability to deliver quality products. To the maximum extent permitted by California law, Power Cookie's total liability to you for any claim arising out of or related to these Terms or your purchase shall not exceed the amount you paid for the order in question.

Power Cookie is not liable for any indirect, incidental, special, or consequential damages arising from the use of our products or website, including but not limited to health-related claims, spoilage, or delivery delays.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of Power Cookie's website or products shall be resolved exclusively in the courts located in California.
